EMPLOYMENT DETAILS IN CANADA

Employing foreign workers in Canada can fill labor shortages and bring new skills and knowledge to help the country’s economy growth, thus being an essential part of a company’s business strategy’

Foreign workers must have a valid work permit to work in Canada. When a foreign worker is employed, the employer must submit an HRSDC Foreign Worker application to the Service Canada Centre.
Before considering a job offer, HRSDC considers whether:

  • The job offer is genuine
  • The wages and working conditions are comparable to those offered to Canadians working in the occupation.
  • Employers made efforts to hire or train Canadians for the job.
  • The foreign worker is filling a labor shortage.
  • The foreign worker will transfer new skills to Canadians.
  • The hiring of a foreign worker will not affect the employment of any Canadian worker.

Once HRSDC approves the job offer, a copy of confirmation letter is sent to the foreign worker.
The foreign worker is informed to apply for a work permit from Citizenship and Immigration.

There are four situations in which you may work in Canada:

  • You are a Canadian citizen or permanent resident
  • Your skills are needed in Canada
  • You are granted permission to work because similar opportunities exist for Canadians to work abroad.

Working in Canada without permission can lead to your being deported from Canada. There are various types of work that can be performed in Canada without a work permit:

  • An accredited diplomat or consular officer.
  • A journalist going to Canada to report on events
  • A professional athlete or member participating in sports event.
  • A business visitor
  • Full time students registered at a degree-granting institution in Canada.

If one has been offered a temporary job in Canada, the employer normally must first contact the local office or the department of HRDC to seek approval of the job offered.
Certain categories may not need to be certified by HRDC, for example:

A senior Manager or Executive, A Religious worker in a charitable organization, an Exchange Professor and Post Doctorate and part of a Film Crew filming in Canada.
