PERMANENT RESIDENCY IN UK
Right of Abode is an immigration status under United Kingdom immigration laws that gives an unrestricted right to live in the UK.All British Citizens have the right to abode. Right to Abode is evidenced by a stamp in the holder’s passport and confers the following rights:
- An unconditional right to live, work, and study in the United Kingdom.
- Entitlement to use the British/EEA immigration channel at United Kingdom ports of entry.
- They may apply for British citizenship by naturalization after meeting the normal residence requirements.
- Children born in the United Kingdom to Right of Abode holders will normally be British citizens by birth automatically.
- Entitlement to apply for UK social security and welfare benefits.
- Right to vote and stand for public office in the United Kingdom.
Indefinite Leave to remain{ILR}, is an immigration status granted to a person who does not hold right of abode in the United Kingdom, but who has been admitted to the UK without any time limit on his stay, and who is free to take up any employment or study without restriction. A person who has indefinite leave to remain, Right of abode, has settled status if resident in the United Kingdom.
Settled status is important for registration as a British citizen requires that the applicant be settled the Uk, and also important where a child of non-British citizen parents is born in the UK, unless at least one parent has settled status the child will not automatically be a British citizen. Prior to 1 July 2006, only a legitimate child could automatically be a British citizen from the father, if the father was a British citizen or settled in the UK when the child was born, the child would become me a British citizen and would be regarded as having been one from the date of marriage.
ILR may be lost if a person leaves the United Kingdom and on return is given leave to enter as a visitor other than for an indefinite period. ILR may also be curtailed by the Home Secretary for reasons of national security or if the holder of the ILR commits an offense that could lead to their deportation from the United Kingdom.
